1Introduction and acceptance

These Terms & Conditions (“Terms”) govern your use of eqtechjo.com and every service provided by مؤسسة الجودة والتطوير التقني, operating as EQTech Jordan (“EQTech”, “we”, “us”).

By browsing the website, creating an account, accepting a quotation, placing an order or using any system we provide, you agree to these Terms and to the policies they refer to. If you act on behalf of a company or organisation, you confirm that you are authorised to bind it.

2Definitions

• Client: any natural or legal person who contracts with EQTech or uses its services or systems.
• Services: everything EQTech provides, including development, hosting, domains, business email, cloud services, support, maintenance and consulting.
• System: any website, online store, application, platform, portal, dashboard or management system (such as ERP, CRM, HR, payroll or accounting) that EQTech designs, develops or operates, with all of its components.
• Client Data: the data the Client or its users enter into, upload to or generate through a System or Service.
• Agreement: the quotation, order, subscription or contract that sets out the scope, price and term of a specific Service.
• Third-Party Services: services provided by other companies that a Service relies on, such as hosting and cloud infrastructure, domain registries, email platforms, payment gateways and software licences.

3Our services

EQTech provides website and online-store development; business management systems (ERP and CRM); HR and payroll systems; accounting systems; cloud services and infrastructure; web hosting and domain registration; business email; and related support, maintenance and consulting. The exact scope, deliverables, timeline and price of each engagement are those set out in its Agreement.

4Quotations and agreements

• A quotation is valid for the period stated on it. Prices on the website are indicative; the price that binds us is the one in the Agreement or at checkout.
• An Agreement is formed when the Client accepts a quotation in writing (by signature, by email or through our website) or pays its first invoice.
• Work outside the agreed scope is not included unless it is added through a written change request.

5Client responsibilities

• Provide accurate information, and the content, materials, access and approvals the work needs, on time.
• Name a contact person who can take decisions and approve deliverables.
• Make sure you hold the rights to any content you give us (texts, images, logos, trademarks and data) and that it is lawful; you are responsible for that content and for any claim arising from it.
• Keep the usernames and passwords of your accounts and Systems confidential, and manage your own users' permissions.
• Use the Services in line with the Acceptable Use Policy.

6Timelines, delivery and acceptance

• Timelines are estimates based on the agreed scope and depend on the Client's timely cooperation; delays in content, feedback, access or payment extend them accordingly.
• A deliverable is accepted when the Client approves it in writing or when the System is put into live operation, whichever comes first.
• Defects reported after acceptance are handled under the support or maintenance terms of the Agreement.

7Change requests

New features, extra pages, additional integrations and changes to approved work are change requests. We confirm their cost and their effect on the timeline before carrying them out.

8Fees and payment

Fees, payment schedules, renewals, cancellations and refunds are governed by the Agreement and by our Payment, Cancellation & Refund Policy.

9Third-party services

Some Services rely on Third-Party Services that are subject to their providers' own terms and policies. EQTech selects and manages them with care but is not responsible for their outages, policy changes or price changes, which may be reflected in the price of the related Service at renewal.

10Intellectual property

Ownership of the Systems we build is governed by the Built with EQTech Jordan Technologies policy. In short: the System, its source code, its server logic and every other component belong exclusively to EQTech; the Client receives a right to use the System under the Agreement; and the Client keeps full ownership of its own content and Client Data.

11Client data and privacy

Client Data is handled under the Client Data Policy. Personal information collected through this website is handled under the Privacy Policy.

12Confidentiality

Each party keeps the other party's non-public business, technical and financial information confidential and uses it only to perform the Agreement. This does not apply to information that is or becomes public through no fault of the receiving party, or that must be disclosed by law or by order of a competent authority. This obligation survives the end of the Agreement.

13Support and maintenance

Support and maintenance are provided at the level set in the Client's plan or Agreement. They do not cover problems caused by changes made by anyone other than EQTech, misuse, failures of Third-Party Services, or force majeure. New features are change requests.

14Warranties and disclaimers

We perform the Services with professional care and skill. Except as expressly stated in the Agreement, Services and Systems are provided “as is”: we do not guarantee uninterrupted or error-free operation, nor specific business results such as search-engine rankings, traffic or sales.

15Limitation of liability

• To the extent permitted by law, EQTech is not liable for indirect, incidental or consequential damages, or for loss of profit, revenue, goodwill or business opportunity.
• EQTech's total liability for any claim is limited to the amounts the Client actually paid for the specific Service that gave rise to the claim during the twelve (12) months before it.
• Nothing in these Terms limits liability that cannot be limited under applicable law.

16Suspension and termination

• We may suspend a Service, after notice where possible, for non-payment, a breach of these Terms or of the Acceptable Use Policy, a security risk, or a legal requirement.
• Either party may end an Agreement as it provides. On termination, the Client pays for the work performed and the costs incurred up to that date; the right to use the System ends or continues as the Agreement states; Client Data is returned or deleted under the Client Data Policy; and EQTech's intellectual property rights remain unaffected.

17Website and accounts

The content of eqtechjo.com is provided for general information and may change without notice. If you create an account on our website — for example to order domains or follow your orders — you are responsible for its security and for all activity under it. We may suspend accounts used fraudulently or in breach of these Terms.

18Force majeure

Neither party is liable for a delay or failure caused by events beyond its reasonable control, such as natural disasters, epidemics, war, government action, power or internet outages, or failures of Third-Party Services.

19Assignment

The Client may not assign or transfer an Agreement, or the right to use a System, to another party without EQTech's prior written consent.

20Governing law, jurisdiction and language

These Terms are governed by the laws of the Hashemite Kingdom of Jordan, and the courts of Amman have jurisdiction over any dispute arising from them; the parties will first try to resolve a dispute amicably. These Terms are published in Arabic and English; if the two versions differ, the Arabic version prevails.

21Changes to these Terms

We may update these Terms from time to time. An update applies from its publication on this page; it does not change a signed contract during its term unless both parties agree.
